Dear Ms. Trammel-Byley:
The Western District of Washington has had the opportunity of investigating Ms. Hudson's request for relocation to this district. She has acceptable residence with her friend, Sue Abelao, whom I have interviewed. However, as noted in your letter dated September 9, 2004, Ms. Hudson has refused to participate in the Inmate Financial Responsibility Program (IFRP) and has refused to make any payment toward her $200 special assessment and her $3,080.04 restitution.
I called Inmate Hudson to ask why she was not paying anything towards the restitution. She stated that she has limited financial resources, but also admitted that she does not believe in paying the restitution. She has filed an appeal, which is currently pending. I informed her that the restitution is a Court order. When she is released and begins supervision, it would be expected that she would start payment toward the restitution or it would be a violation of her supervision. She does not plan to change her position and refuses to pay anything to the restitution. Therefore, this district is denying her relocation to the Western District of Washington. If Ms. Hudson should win her appeal, and the restitution is deleted or replaced with community service work, which she states she is willing to do, this district would be willing to revisit the relocation request.
